Q. An owner in our building has a tenant who has a contract to purchase the unit on a "rent to own" basis. Since the tenant is not yet legally an owner, can she be responsible for voting on the board members or even serving on the board herself?

A. The question of who can legally serve as a board member or submit ownership votes in a condominium association is often misunderstood. We regularly find that individuals serving as board members are in fact not legally able to serve. The IL Condo Act is very specific on this matter however, in stating that
