Q, We recently moved to Chicago and purchased a unit in a small ten unit condominium association.  We would like to know if there is anything written in the Illinois Law that states how many people can serve on the Board of Directors.

We have over 50% owners on the Board (five total), and one unit stands empty.  These board members have made questionable, closed door financial decisions on many issues, and stand to re-elect themselves next week.  We'd appreciate your input.

 

A. The IL Condominium Act requires that a minimum of three owners serve on the board.  Your association's bylaws will state the required number for your association.  If the bylaws state that only 3 owners are required, it may also grant the board the right to increase that number by a vote of the board.  It is not unusual for 5 members to be required by the bylaws specifically, or for boards to vote to increase the size of their board beyond the minimum required.

You should consult your bylaws to determine how many board members are required and whether or not the board has the right to increase or decrease the number.

Board members are voted in by the owners.  Votes are cast by ownership percentage.  If the remaining unit owners are of the same mind and wish to make a change to the current board, it may be possible to pool your votes to ensure the replacement of one or more board members.
